New regulatory developments are changing the landscape for Colorado landfill owners. Regulation 31 was approved by the Air Quality Control Commission (AQCC) within the Colorado Department of Public Health and Environment (CDPHE) in December 2025. This regulation establishes one of the nation’s most comprehensive methane-reduction programs for municipal solid waste landfills. The rule introduces stringent methane-generation thresholds, earlier gas-collection requirements, extensive surface-emissions and leak-detection protocols, remote-sensing enforcement triggers, expanded reporting obligations, a phase-down of open flares, and new intermediate cover standards. Deadlines for certain requirements begin as early as June 2026.
